LEGAL INFORMATION
NEXT LEVEL, along with its affiliates (“NEXT LEVEL,” “Company,” “we,” “us”), provides this website and related services (collectively, the “Site”) subject to the following Terms of Use. Please read this Agreement carefully. By accessing or using the Site, you agree to be bound by these terms and all incorporated references. If you do not agree, do not use the Site.
This Agreement is made between the Company and you, the Site visitor and/or registered user. This agreement, along with our Privacy Policy, contain the terms upon which we agree to provide, and which govern the use and operation of, the Site.
We may update this Agreement from time to time to reflect changes to our services, business practices, legal or security requirements, or to prevent misuse. We’ll provide notice of any changes in a manner we consider reasonable. By continuing to use the Site, you accept the updated terms.
You must be at least 18 years of age to use the Site.
Account Types
For purposes of this Agreement, the following account types are recognized on the Next Level platform:
- Next Level Community Professional: an individual who has registered on the Next Level Community platform, built out a profile, and consented to their profile being visible to clubs and potential employers.
- Club / Client Account: an employer account held by a private club or organization using the Next Level platform for job posting and hiring management.
- ATS Applicant: an individual who has submitted a job application through the Next Level ATS on behalf of a Club / Client Account. ATS Applicants are not Next Level Community Professionals unless they separately accept an invitation to join the Next Level Community.
OWNERSHIP; PROPRIETARY NOTICES

WARRANTY INFORMATION; DISCLAIMER
The Site and all related services, content, and features are provided “as is” and “as available,” without warranties of any kind, express or implied. NEXT LEVEL and its affiliates, suppliers, and agents disclaim all warranties, including those of title, merchantability, fitness for a particular purpose, non-infringement, and data accuracy.
We do not guarantee uninterrupted or error-free use of the Site. NEXT LEVEL does not control or verify user-submitted content and is not responsible for inaccuracies, errors, or third-party changes to the Site. We are not involved in transactions between candidates and employers, nor do we guarantee outcomes related to resumes or job postings. You are solely responsible for the content you post.
LIMITATION OF LIABILITY
We do not limit or exclude liability where it would be unlawful to do so, including for fraud, intentional misconduct, or knowing violations of the law or this Agreement.
Where permitted by law, NEXT LEVEL and its affiliates, suppliers, advertisers, agents, and sponsors are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages regardless of legal theory or whether we knew such damages were possible.
To the extent allowed by law, our total liability to you or any third party is limited to $100 USD.
ACKNOWLEDGEMENT
This Site may contain links to third-party websites that are not controlled or endorsed by the Company. We are not responsible for their content, policies, or any loss or damage resulting from their use.
VOID WHERE PROHIBITED
While the Site is accessible globally, not all products or services are available in all locations. We may limit access to the Site or its services by location, user, or quantity at our sole discretion.
CODE OF CONDUCT
By using the Site, you agree not to, without written permission from NEXT LEVEL:
- Post false, misleading, outdated, or incomplete job or resume information.
- Post jobs that are not hospitality-related or not affiliated with your verified organization.
- Use excessive keywords, duplicate or plagiarized job posts, or mislead applicants.
- Include unauthorized contact info or bypass the “Apply Now” function.
- Resell access, share login credentials, or allow unlicensed users access.
- Use bots, scraping tools, or unapproved software to access or store Site data.
- Leave expired or on-hold job postings live for more than 24 hours.
- Spam or solicit Site users via email, phone, or direct message.
- Impersonate others or misrepresent your affiliation.
- Post unlawful, infringing, harmful, or offensive content or software.
- Post job ads that violate employment laws or discriminate unlawfully.
- Contact users unsolicited for commercial or recruiting purposes outside of posted jobs.
- Collect or use candidate information for non-hiring purposes.
By using the Site, you agree to provide and maintain accurate, up-to-date information, keep your login credentials secure, notify us immediately of any security issues or unauthorized access, and comply with all applicable laws and regulations.
Club / Client Account — Job Posting Legal Release
| Our clients and clubs are responsible for ensuring the content of their job postings complies with all applicable Federal, State, and Local employment law requirements, including but not limited to anti-discrimination laws, wage and hour requirements, and equal opportunity employment obligations. Next Level reserves the right to remove any posting that contains discriminatory, misleading, or otherwise inappropriate content and may suspend the club’s account pending review. Next Level’s removal of a posting does not constitute a finding of legal violation and does not limit any other remedies available to Next Level under this Agreement. |
Next Level Community Professional — Registration Acknowledgment
| I agree to Next Level’s Privacy Policy and Terms & Conditions. I understand that information I choose to make public on my profile will be visible to clubs and potential employers, and I consent to being contacted regarding career opportunities. I can manage my visibility and contact preferences at any time in My Profile. |
Community Professionals may update their visibility and contact preferences at any time through My Profile. Individual fields may be toggled between public (visible to clubs and potential employers) and private (visible to Next Level only). Field designations are clearly labeled within the My Profile interface.
ATS Applicant — Application Consent
The Next Level ATS is operated and hosted by Next Level on behalf of Club / Client Accounts, including when presented under a club’s branding or white-label interface. When an individual submits a job application through the Next Level ATS, they are informed that their application is processed through Next Level. Submitting an application constitutes consent to Next Level’s Privacy Policy and Terms of Use, in addition to the applicant’s information being shared with the Club / Client Account for consideration for the role.
Because this consent is established at the point of application, Next Level may invite ATS Applicants to create a Next Level Community Professional account without requiring a separate legal consent event. Accepting the invitation and activating a profile requires only acknowledgment of the profile visibility statement. Accepting the invitation is entirely voluntary and is not a condition of the job application.
ATS SUBSCRIPTION, CANCELLATION & OFFBOARDING
The following terms apply to Club / Client Account subscriptions that include access to the Next Level Applicant Tracking System (ATS).
Cancellation Notice
- ATS subscriptions require sixty (60) days written notice to cancel, delivered to info@nextlevelkkw.com.
- The cancellation date is sixty days from receipt of written notice.
Job Posting Restrictions During Cancellation Period
- No new job postings may be submitted to the Next Level platform within the final thirty (30) days prior to the cancellation date.
- Job postings submitted prior to the thirty-day restriction window may remain live for their standard thirty (30)-day posting lifecycle under the current agreement terms.
- Clubs wishing to continue posting on Next Level after ATS cancellation may do so at standard posting-only rates.
60-Day Offboarding Timeline
- Days 1–30 — Active Transition Period: Club retains full ATS access. Club is responsible for beginning setup on any replacement system and for notifying ATS Applicants in active pipelines of the platform transition. No new Next Level job postings are permitted after Day 30 of this window.
- Days 31–60 — Read-Only Verification Period: ATS access transitions to read-only mode. Club may review and verify all applicant records and confirm transfers are complete. No edits, new applications, or postings may be made. Data export must be completed during this window.
- Day 60 — Access Termination: Full account access is closed. Data export requests after this date are not guaranteed.
Data Export at Termination
Next Level will provide a data export upon request during the read-only period (Days 31–60). The export includes job postings, applications received, pipeline status, recruiter notes, and communications logs. The export does not include Next Level Community Professional confidential account settings, which are proprietary Next Level data and are not transferred to any third party under any circumstances.
ATS Applicant Notification Responsibility
It is the Club / Client Account’s sole responsibility to notify ATS Applicants in active pipelines of the platform transition. Next Level is not responsible for applicant communication during the offboarding period. The sixty-day notice structure is specifically designed to provide adequate time for applicant notification and record transfer.
ACCOUNT GRACE PERIOD & REINSTATEMENT
Club / Client Accounts
- If a Club / Client Account’s payment lapses, the account enters a fifteen (15)-day grace period. During this period, club administrator and hiring manager access is suspended. Next Level recruiter access is maintained for account management purposes. Active job postings remain live during the grace period.
- If the account is brought current within 15 days, full access is restored with no interruption.
- If the account is not brought current within 15 days, the account is suspended. Club data is retained for twelve (12) months. Reinstatement within 12 months restores full account history. Reinstatement after 12 months requires a new account setup.
Next Level Community Professional Accounts
- Community Professionals may deactivate their profile at any time. Deactivated profiles are hidden from all platform surfaces immediately. Data is retained for twenty-four (24) months from deactivation.
- Community Professionals who return within 24 months will have their full profile and history restored upon reactivation.
- Community Professionals who return after 24 months, or who have permanently deleted their account, must create a new account. Prior data is not restored.
MAKING PURCHASES
When you purchase through the Site, your payment and required information are processed by a third-party payment processor. By providing this information, you agree it is accurate and authorize us to instruct the processor to complete your transaction. You are responsible for all charges and applicable taxes at the prices in effect when incurred. All purchases are non-refundable unless otherwise stated or required by law.
SUBMISSIONS
By submitting or posting any materials or Content to the Site, you grant us a worldwide, royalty-free, sublicensable, and perpetual license to use, reproduce, distribute, adapt, display, and create derivative works from your Content in any media. You retain ownership of all copyrights and trademarks. The Company does not endorse or guarantee the accuracy of any Content and may remove any Content at its discretion.
REGISTRATION; USE OF SECURE AREAS AND PASSWORDS
Some Site areas require registration. By registering, you agree to provide accurate, current information and keep it updated. Your username will be your email address, and you must choose a password. You are solely responsible for all activity under your account. If you suspect your account is compromised, update your password and notify us at info@nextlevelkkw.com.
CLAIMS OF COPYRIGHT INFRINGEMENT
If you believe content on our Site infringes your copyright, you or your agent may submit a removal request including your signature, identification of the copyrighted work, identification of the infringing material, your contact information, a good faith belief statement, and a statement of accuracy under penalty of perjury. MISCELLANEOUS
You and NEXT LEVEL agree that Arizona state and federal courts have exclusive jurisdiction over any disputes related to this Agreement or the Site. The prevailing party is entitled to costs and attorney’s fees.
Severability: If any part of this Agreement is unenforceable, the rest remains effective. Waiver: Failure to enforce any term does not waive the right to enforce it later. This Agreement, including the Privacy Policy, is the complete agreement between you and NEXT LEVEL.
