Protecting your private information is our priority. This policy explains how we process personal data collected through our business. We are NEXT LEVEL a Recruiting Firm located in the United States (“NEXT LEVEL,” “we,” “us,” and “our”) and this privacy policy (the “Policy”) applies to anyone who is using or has access to the NEXT LEVEL website found at www.nextlevelkkw.com (the “Site”) or our Services. It is important that you understand what information we collect when you visit the Site and what we may do with that information.

By using the NEXT LEVEL Site, you consent to the terms of this Policy and our Terms of Service. DO NOT use this Site or submit any personal information, or content of any kind, if you do not agree to the terms of this Policy and our Terms of Service.

NEXT LEVEL understands how important your privacy is to you and as such takes the security of your privacy seriously. All reasonable measures are taken to protect your privacy.

Definitions

Candidate(s) means an individual who is a candidate, applicant, potential candidate, or any individual searching for employment or services and/or information related to their employment or job search, and/or employee of a Client.

Client(s) means any business, organization, or individual that retains us to perform any of our services, including those seeking information regarding or filling employment openings on their or other’s behalf.

Next Level Community Professional means a Candidate who has registered on the Next Level platform, built out a profile, and joined the Next Level Community. Next Level Community Professionals have access to full platform features and their profiles are visible to clubs and potential employers on the platform.

Club / Client Account means an employer account held by a private club or organization using the Next Level platform to post jobs and manage hiring.

ATS Applicant means an individual who has submitted a job application through the Next Level Applicant Tracking System (ATS) to a job opportunity within a Client / Club Account. . The ATS is operated and hosted by Next Level; by submitting an application, ATS Applicants consent to Next Level’s Privacy Policy and Terms of Use in addition to their application data being shared with the Club / Client Account. An ATS Applicant has not joined the Next Level Community and their profile is not visible on the platform. Because ATS Applicants have already consented to Next Level’s terms at the point of application, they may be invited by Next Level to create a Next Level Community Professional account without requiring a separate legal consent event. Accepting the invitation is entirely voluntary and is not a condition of the job application. Upon accepting, the standard Community Professional registration acknowledgment applies.

Collection of your Personal Information

We collect and store a variety of information from you when you visit and actively submit certain information to the Site. Some information is personal and some is not.

Personal identifiable Information: Information that identifies, relates to, describes, is capable of being associated with or could reasonably be linked, directly or indirectly with a particular Client, or Candidate, such as your name, email address or image, or information that can be used to identify you when combined with other information, is “personally identifiable information” (“PII”).

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use the Site, email a cover letter and resume, sign up for recruitment services, sign up to receive our email announcements, send us an email message, or call us.

Collection of PII from Next Level Community Professionals

During registration and throughout use of the Next Level Community, we collect and store the information that you provide to us directly.

The PII may include: your name, physical address, email address, telephone number, employment history including employer, job title, compensation, education, degrees and/or certifications, benefits, your resume, among other PII needed to provide services to you and our Clients.

We encourage you not to provide us with sensitive personal data, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, and/or data concerning your health or sex life and sexual orientation.

We will use your information for, but not limited to, communicating with you or our Clients in relation to services you have requested from us, including:

  • Processing job applications and contacting our Clients on whose behalf we are instructed to help fill a job posting.
  • Candidate searches. If we believe you are qualified for a vacant position, we may pass your information on to the relevant Client.
  • Improving the services we offer.
  • Preventing fraud, spam, and other potentially fraudulent or illegal activities.
  • Direct marketing and communications. You may opt out of these communications at any time.
  • We also may gather additional personal or non-personal information in the future as well as collect personal data from third-party databases and other public sources.

Confidential Account Settings & Platform Data Boundary

In addition to public profile information, Next Level Community Professionals may provide confidential account settings that are used exclusively by Next Level for algorithmic job matching and recruiter review. This information is strictly internal to Next Level and is never shared with clubs, potential employers, or any other platform user.

Confidential account settings include, but are not limited to:

  • Job search status (not looking, open to opportunities, actively looking)
  • Desired salary range
  • Desired roles and titles
  • Desired location and relocation preferences
  • Availability timeline
  • Current compensation
  • Do Not Contact preferences (specific clubs or regions to exclude from outreach and matching)
  • Premier Prospect opt-in/opt-out status

Platform Data Boundary: Confidential account settings are never included in any data export provided to Club / Client Accounts upon account termination or otherwise. This data is the exclusive property of Next Level and is not transferred to any third party.

Collection of PII from ATS Applicants

When an individual submits a job application through the Next Level ATS, the ATS is operated and hosted by Next Level on behalf of the Club / Client Account. Next Level is a data controller for this information, not merely a pass-through. This is true even when the ATS is presented under a club’s branding or white-label interface.

At the point of application submission, applicants are informed that their application is processed through Next Level and are presented with a link to this Privacy Policy and our Terms of Use. Submitting an application constitutes consent to both.

Information collected may include name, contact information, resume, employment history, and other details relevant to the position applied for. This information is shared with the Club / Client Account on whose behalf the posting was made.

Upon cancellation of a Club / Client Account, ATS Applicant records are included in the club’s data export. Next Level retains a copy of this data in accordance with our data retention policy below.

ATS Applicants are not Next Level Community Professionals. Their application data is not visible on the Next Level platform. Because ATS Applicants have already consented to Next Level’s Privacy Policy and Terms of Use at the point of application, Next Level may invite them to create a Community Professional account without a separate legal consent event. Accepting the invitation is entirely voluntary and is not a condition of the job application. Upon accepting, the Community Professional registration acknowledgment applies, covering Privacy Policy, Terms & Conditions, and profile visibility preferences.

If an ATS Applicant creates a Next Level Community Professional account, their prior application history will be linked to their new profile.

Collection of PII from Club / Client Accounts

In order to perform the services to which you have engaged our business, we may collect various information about your organization, as well as PII for a point of contact. Information collection may include, but is not limited to:

  • Point of contact name, physical address, email address, and phone number

Additional Information Collected

Facility information: vacant job position description, facility name, year founded, number of members, club ownership type, total acreage, square feet of clubhouse, facilities descriptions, golf holes and rounds, spa offerings, and club metrics including gross revenue, gross dues, and food/beverage totals, among other things.

We may collect and store other information you provide during the course of our services that you have mandated from us.

Data Retention & Account Management

Next Level maintains data in accordance with the following retention policy. Community Professionals and Club / Client Accounts may request account status changes at any time by contacting us at info@nextlevelkkw.com.

Next Level Community Professional Accounts

  • Active accounts: data retained for the life of the account.
  • Deactivated accounts: when a Community Professional deactivates their account, their profile is hidden from all platform surfaces immediately. All data is retained in full for 24 months from the date of deactivation. If the Community Professional returns within 24 months, their full profile, history, and connections are restored.
  • Deleted accounts: Community Professionals may request permanent deletion at any time. Upon deletion, all personally identifiable information is permanently removed. Anonymized, non-identifiable data may be retained for platform analytics. Deletion is irreversible.
  • Auto-transition: accounts that remain deactivated for 23 months will receive an advance email notification. Accounts that remain deactivated for 24 months will automatically transition to deleted status.

Club / Client Accounts

  • Active accounts: data retained for the life of the subscription.
  • Lapsed accounts: if payment lapses, the account enters a 15-day grace period. Data is retained in full during this period. Full access is restored upon payment.
  • Cancelled accounts: Club / Client Account data is retained for 12 months following the cancellation date. If the club reinstates within 12 months, full account history and profile are restored. Reinstatement after 12 months requires a new account setup.

ATS Applicant Records

ATS Applicant records are retained for the duration of the associated Club / Client Account subscription. Upon account cancellation, ATS Applicant records are included in the club’s data export and Next Level retains a copy. If an ATS Applicant creates a Next Level Community Professional account, their records are subject to the Community Professional retention policy from the date of registration.

Sharing Information with Third Parties

NEXT LEVEL does not share, sell, rent or lease its customer lists or PII to third parties or advertisers.

NEXT LEVEL may, from time to time, contact you on behalf of our Clients or Candidates, or external business partners about a particular offering that may be of interest to you, or to help us with our operations such as data storage or fraud detection.

NEXT LEVEL may share data with trusted business partners to help perform services in connection with our operations, to improve our Site, and to better protect and understand our users’ needs. All such third parties are prohibited from using your personal information except to provide these services to NEXT LEVEL, and they are required to maintain the confidentiality of your information.

NEXT LEVEL may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on NEXT LEVEL or the Site; (b) protect and defend the rights or property of NEXT LEVEL; and/or (c) act under exigent circumstances to protect the personal safety of NEXT LEVEL’s Clients or Candidates, or the public.

Links to Other Websites

Our website may contain links to other websites of interest. However, once you have used these links to leave our site, we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide while visiting such sites. You should exercise caution and look at the privacy statement applicable to the website in question.

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
